Council of Europe’s formal relations with Non-Governmental Organisations

From its inception the Council of Europe established working relations with non-governmental organisations. The Council recognised their influence as early as 1952 when it opened the possibility for non-governmental organisations to acquire “consultative status”. At present around 400 international non-governmental organisations (hereinafter referred to as INGOs) have enjoyed consultative status with the Council of Europe. Resolution (2003)8 adopted by the Committee of Ministers on 19 November 2003, replaces “consultative status” with “participatory status”. When NGOs are granted this status, the steering committees, committees of governmental experts and other bodies of the Committee of Ministers, the commissions of the Parliamentary Assembly, the Congress of Local and Regional Authorities of the Council of Europe as well as the Commissioner for Human Rights may involve the INGOs enjoying participatory status in the definition of Council of Europe policies, programmes and actions in particular by granting observer status to the Liaison Committee and to the INGO thematic groupings. Additionally, considering their role as advisers in questions concerning civil society, the Secretary General may consult the INGOs, the Liaison Committee or the INGO thematic groupings, in writing or by means of a hearing, on questions of mutual interest.

Relations formelles du Conseil de l’Europe avec les organisations non gouvernementales

Depuis sa création, le Conseil de l’Europe entretient des relations de travail avec les organisations non gouvernementales. Dès 1952, il a reconnu leur influence en leur offrant la possibilité d’obtenir un «statut consultatif». Depuis, ce sont environ 400 organisations internationales non gouvernementales (désignées ci-après par le sigle OING) qui ont bénéficié du statut consultatif auprès du Conseil de l’Europe. La Résolution (2003)8 adoptée par le Comité des Ministres le 19 novembre 2003, décide de remplacer le statut consultatif par un statut participatif.

Une fois que le statut participatif a été accordé aux OING, les comités directeurs, les comités d’experts gouvernementaux et les autres instances du Comité des Ministres, les commissions de l’Assemblée parlementaire, du Congrès des pouvoirs locaux et régionaux du Conseil de l’Europe ainsi que le Commissaire aux Droits de l’Homme peuvent impliquer les OING dotées du statut participatif, dans la définition des politiques, des programmes et des actions du Conseil de l’Europe, notamment par l’octroi d’un statut d’observateur à la Commission de liaison et aux regroupements thématiques des OING. En outre, compte tenu de leur rôle de conseillers pour les questions concernant la société civile, le Secrétaire Général peut consulter les OING, la Commission de liaison ou les regroupements thématiques des OING, par écrit ou sous forme d’audition, pour des questions d’intér�t mutuel.

L’A.I.F. est dotée du statut participatif et figure parmi les ONG internationales ayant droit à saisir le Comité européen des droits sociaux lorsqu’elles estiment que la Charte n’est pas respectée (système de réclamations collectives).
